These Terms of Use ("Terms") govern your use of the Fish Alert mobile application ("the app") and the bytewindow.org website, both provided by Byte Window ("we", "us", "our"). By using the app or site, you agree to these Terms. If you don't agree, please don't use them.

1. What Fish Alert is

Fish Alert provides a weather-derived "fishability score" and related information for general information only. It is there to help you decide when conditions might be good for fishing.

Not a safety tool. Scores and forecasts are estimates, and they can be wrong. Do not rely on Fish Alert for safety, navigation, or weather-warning decisions. Always check official weather and marine warnings, and use your own judgement, especially on or near water. Follow all local fishing laws, licences, bag limits, and access rules.

2. Weather data

Weather information is sourced from third-party providers, including Open-Meteo. We don't control that data and don't warrant its accuracy, completeness, timeliness, or availability.

3. Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use. You agree not to misuse the app or site. For example, do not reverse-engineer it (except as permitted by law), interfere with its operation, or use it unlawfully.

4. Intellectual property

The app, this site, and the Byte Window and Fish Alert names, logos, and content are owned by Byte Window and protected by intellectual-property laws. These Terms don't transfer any of those rights to you.

5. Disclaimer of warranties

To the maximum extent permitted by law, the app and site are provided "as is" and "as available", without warranties of any kind, whether express or implied.

6. Limitation of liability

To the maximum extent permitted by law, Byte Window will not be liable for any indirect, incidental, special, or consequential loss, or any loss arising from your reliance on the fishability score or weather information.

Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or other laws that cannot be lawfully excluded. Where our liability for a failure to comply with a non-excludable guarantee can be limited, it is limited to re-supplying the relevant service (or the cost of doing so).

7. Changes

We may update the app, the site, or these Terms from time to time. We will change the effective date above, and continued use after changes means you accept the updated Terms.

8. Governing law

These Terms are governed by the laws of Australia and the State or Territory in which Byte Window is established, and you submit to the non-exclusive jurisdiction of its courts.
